Jurisprudence Law Essay Example | Topics and Well Written Essays - 2000 words
Jurisprudence Law - Essay Example The law concept has to offer an account of the most essential or important aspects of a legal system and also accounts for the laws normativity4. It is important to establish the indispensable aspects of law so that it is possible to differentiate the legal and non-legal and also the legal validity and the legal invalidity. The law is widely known as a social institution that influences the realistic reasoning of agents. Social facts are a matter of what is considered as law and what is not considered as law; as a result we can determine the validity of the law by referring to social sources as opposed to moral evaluation. Law is not essentially obligatory because of its morality validity. Judges and lawyers should not bother with the question if a law is just or not but if there is any law of a particular issue. The law has particular features, and it have them because of its very essence or nature as law wherever and whenever it is established5. The law is a normative social practi ce because it asserts to direct human actions, bringing about a reasons for taking action. There is need to comprehend the general circumstances that would render all types of accepted norm legally valid. Judges and lawyers should consider the source of the norm as well as the matter of the content of the norm(s). This entails the general question on the legal validity conditions. Second, the normative feature of the law should also interest the lawyers and judges. Each legal norm has to be composed of a threat supported by sanctions. This takes in two different claims. From the moral perspective, we cannot take the recognition rules in themselves as basis for requirement to follow the law. The law is an institutionalized normative system, which is upheld by an agreement among the officials (judges and lawyers) who apply the rules and who are in a manner differentiated from the normal workings of value and reason. The Darwinian controversy of the nineteenth century Essay
The Darwinian controversy of the nineteenth century - Essay Example The transmutation of species was accepted by many scientists before 1859, but the publication of Charles Darwins On the Origin of Species by Means of Natural Selection provided the first cogent theory for a mechanism by which evolutionary change could occur: natural selection. (Mayr, 2002) Darwins theory nearly shattered the traditional Christian notion that humanity, poised between beast and angel, was literally formed in Gods image. Darwin pointed out, long before we knew that we share 98.5 percent of our genetic material with chimpanzees, that what looks back at us in the mirror is not the face of God but is kin to the earthbound apes. As the Edinburgh Review warned at the time, "a revolution in thought is imminent, which will shake society to its very foundations by destroying the sanctity of the conscience and the religious sense." (Zimmer, 2002) All the statements of Darwinian Theory were in strong contradiction with the religious views. Darwin was sure that life on Earth is directly connected with the fight for living. In addition the strongest survives and the weakest loses their right for living. According to Darwinââ¬â¢s theory there is always a great resistance and contradiction in nature. More over Darwin supposed that this theory reflected the life of humans also. This, of course, was totally opposite to religious views, where everything should exist in harmony with each other. Religion considers that life is given to everyone and we should co-exist in the world peacefully. It is interesting that Indian anthropologist Lalita Vidyardi, who devoted many years of her life to the learning of Darwinism, states that Darwinian theory of evolution, caused the ideas of racism in social sciences. She said that many scientists believed that the civilization and progress in the world were achieved thanks to the white race and in the second part of the XIX-the century the phenomenon of racism was accepted as a fact by a greatest part of

Participation Discussion Questions Essay Example | Topics and Well Written Essays - 1000 words - 1
Participation Discussion Questions - Essay Example ââ¬ËThese laws protect the employees in matters such as compensation, working conditions, and retirement benefits. I agree with you that it is imperative for managers to have excellent knowledge of employment laws. Managers lower their business risk by complying with employment laws because a lack of compliance can lead to governmental fines, civil lawsuits, and a loss of brand value. If a corporation fails to comply with basic employment laws such as paying at or above minimum wage they can incur in damages beyond the potential fines. The customer can lose confidence in the corporate behavior of the company and switch to the competition. In the 21st century corporate social responsibility has become an important strategy to achieve business growth. The utilization of hiring practices that foster diversity has positive benefits such as improving creativity and gaining insight into other cultures. If an employee violates employment laws a manager must discipline the person and possible terminate employment if the violates warrants such punishment. Knowledge is power, thus education the workforce on employment will improve the quality and value of the human capital of a corporation. As you mentioned understanding employment laws is a two way process since both employer and employees are affected by them. Applying educational efforts in the corporate world to increase the knowledge of employees of employment laws is a sound investment. The overall business risk of an enterprise decreases as the employees become more knowledgeable of employment laws. Diminishing interpersonal conflict due to a lack of knowledge of employment increases the productivity of the workers. I liked your idea of creating handbooks with information regarding employment laws. Doing so is an initiative that provides documentation the workers can use to study on their own time about employment laws as well as reference

Process Design for Riordan Manufacturing Essay Example for Free
Process Design for Riordan Manufacturing Essay Dear CEO: At Riordan, the electric fan division has revised the process for supplying the electric fans. Part of Riordanââ¬â¢s operations planning, Riordan would implement aggregate operations. From Operations Management for Competitive Advantage (2006), ââ¬Å"Aggregate operations planning involves translating annual and quarterly business plans into broad labor and output plans for the intermediate term of 6 to 18 months. Its objective is to minimize the cost of resources required to meet demand over that period.â⬠Riordan would start to collect data starting from the beginning of the fiscal year. The data would be collected throughout the months to help determine implementation plans. Part of the total quality management for the electric fans would be to implement the eight steps to be successful. From The Eight elements of TQM (2012), Riordan would apply, ââ¬Å"ethics, integrity, trust, training, teamwork, leadership, recognition, and communication,â⬠within its training and everyday workday routines. The process uses a viewpoint that strengthens the power of performance within planning, management, leadership, and design department. These departments have initiated improvements. By implementing the process to the management and staff, Riordan would have an easy workflow. Riordion Manufacturing looks forward to hearing any opinions and concerns regarding the new development for processing of distributing the electric fans. Thank you for your time in advance, Best Regard, Learning Team A Team A will present a proposal package for Riordan Manufacturing Companyââ¬â¢s electric fans. This proposition analyzes the importance of the MRP in regard to the fans. In addition, a newly created process design for the production of the electric fans, and a discussion regarding the supply chain that takes advantage of the global prospects that lower labor costs. Last, the team will cover the production forecast for the electric fans along with the implementation plan that will include a design process included within a Gantt chart. MRP for the manufacturing of the Riordan electric fans Many organizations strive to be competitive. Riordan Manufacturing is one of those companies located in Hangzhou, China. This company creates fan blades, fan housings, and supplier for the electric fan motors. Riordan Manufacturing located in China currently uses raw materials to make the fan blades, housings, and other miscellaneous parts. The departments focus on the cost it takes to create the plastic fans to stay ahead of the competition. A new process design can improve Riordan Manufacturingââ¬â¢s output of its process analysis. New Process Design For Production The process developer calls for the entire workforce within the operation to be fully involved. Strategically, Riordian can operate most desirably in the terms of cost, competences within the vendors, and inventory, (Whitney, 1988). Creating a new process design for the manufacturing of Riordan electric fans will adjust the cost for the local vendors. When addressing operating costs and inventory it is paramount to reduce the relationship with their Chinese partners. This is true with any business; it is never a smart move to have more employees than required. Riordan Manufacturing experts have the knowledge and capabilities to order the fan motors and blades needed for assembly. Using local outsourcing manufacturing companies for purchasing the fan motors will lower costs with the new process in place. A way to cut developing time is to begin the process of the phase two at the same time phase one is completed. An implicated cycle can make the transition from phase to phase. Riordan ââ¬â¢sà process currently in use causes concern because of the slow results from its third party. Therefore, creating additional inventory on-site would rectify this situation. The fan motors in inventory will create an efficient development process that does not overlap phases. ââ¬Å"To improve the effectiveness of overlapping, the upstream activity should make solutions ââ¬Ëdownstream-friendlyââ¬â¢, reducing meaningless changes, and quickening engineering cycles. The downstream should try to forecast upstream results. Knowing how to make time-risk trade-offs and quicken adjustment to unexpected changesâ⬠, (Clark Fujimoto, 1991). With the use of outside manufacturing companies to assemble the electric fan motors, support the economical cost needed for the new process. Subsequently Riordan Manufacturing proposes to have higher levels of inventory that allows them in effectively forecasting models for inventory control, production, planning, improving supply chain, and guaranteeing deliveries of Riordan products. Creating a new process design essentially caters for the new supply and demand of Riordan products. Using lean production can help Riordan Manufacturing minimize waste from raw material toward the finished product. Because of the elevated demand for the product, production needs increase (Chase, Jacobs, Aquilano 2006). Global Advantages and Opportunities Riordan Manufacturing operates their electric fans unit out of Hangzhou, China but sells them across the world, Apollo (2012). The company has been successful in using a method call make-to-stock operations. The flowchart will illustrate an innovative system that ensues extremely efficient. This method has been successful because the product is available when our customer places his or her order. The customer has the option to have his or her product delivered or picking-up his or her product from the local warehouse. In addition, our company offers a responsive supply chain. Riordan is responsive and flexible to the customerââ¬â¢s needs. Moreover, if a customer wanted a special order, the company offers the build-to-order process to meet the specialized requirements for the order. Chase, Jacobs, Aquilano (2006), describes this as the Responsive Supply Chain Method. Our flexibility can accommodate any customer requirements. In this global market, the available opportunities are competitive. According to theà European Business Review article, the opportunities of global advantages will depend on the nationââ¬â¢s determinants. In applying the determinants to Riordan in China, the market has a large availability of skilled labor. Furthermore, a high-demand for the product within the supply network has driven the success for Riordan. Last, this company has diverse suppliers working with the manufacture to produce the electric fans. These factors alone stimulates the competition, in return increases the total supply capacity. These determinants of advantages make this company competitive in the global market. Supply Chain Flowchart Production Forecast Riordan forecast proposes the yearly needs of electric motors to the local companies based on three years of sales and production figures. The current yearââ¬â¢s estimation for production of electric fans produces a need to outsource to several local vendors. One of the outsourcing components in producing the fan is the plastic polymers. The outsourcing company produces these individual parts by specification to fit inside the fans. The fan blade and the fan housing components are assembled onsite to the motor. Then the minor parts are added to the fan for its completion. Once production of the fan finalizes, the product become part of the inventory placed into the storeroom as available saleable product. From the storeroom, the customers can pick up their fans from the manufacture. Alternatively, Riordanââ¬â¢s transportation department can have the product delivered using local Chinese shipping company. Riordan maintains extra stock of polymerââ¬â¢s but not the electric motors. Nevertheless, the outsourcing motor supplier and Riordan have an agreement to store extra stock at their facility reducing the overhead and lowering the cost for the product. Ganatt Chart and Design Process As part of the implementation plan, five different tasks assist in developing the electric fans. The first task would be the preliminary design. The second task would be the detail design. The third design would be the prototype. During which the fourth and fifth task provide the testingà and assembly of the electric fans. The white shaded bars implements the period used for each tasks. The parts colored purple within the bars are goals into which Riordan would use as a set goal to achieve production. Conclusion In conclusion, Riordian has submitted the development of a new process for its distribution of electric fans, the process focus on what strengthens the company with countless leaders, designers, planners, and improvement within this proposal. Riordan has been a very successful company and emphases through this proposal the positive aspects of initiating a joint venture. References Apollo Group, Inc. Comparing Life Without Meaning in Eliotââ¬â¢s The Waste Land and Wellesââ¬â¢ Ci
Life Without Meaning in T. S. Eliotââ¬â¢s The Waste Land and Orson Wellesââ¬â¢ Citizen Kane It is the foundation of modern civilization that knowledge is better than ignorance, understanding more valuable than confusion, and wisdom more desirable than foolishness. Consequently, people feel that they should be able to understand the meaning of life and, in doing so, know that their lives are not in vain. They want life to be a coherent whole infused with meaning, so that they can know and understand what life is and where they fit in, thereby attaining wisdom. Life, then, is in essence a struggle to find a meaningful framework for the experiences and feelings we have collected. Since art reflects the human state, and we have grown more conscious of this struggle, our art has come to reflect this problem of making a coherent, meaningful whole out of the assorted fragments of life we have collected. Though this theme of collecting is visible in all media of modern art, it is especially noticeable in literary and film art, in particular in T. S. Eliotââ¬â¢s The Waste Land and Orson Wellesââ¬â¢s Citizen Kane. These two pieces analyze collecting on two levels: first because they focus on collecting and second because they are collections. However, the division between these levels is somewhat superficial, as both Eliot and Welles blur the lines between the two parallels, making the audience more acutely aware that this art is a picture of all human life. On both levels the artists draw parallels between the works and the audiencesââ¬â¢ lives by examining the content, style, and meaning of the collection; that is, what is collected, how it is collected, and what it says, concluding that life is not a coherent whole, but rather ââ¬Å"a heap of broken ima... ...to be. Collecting points out that in the very act of observing the art, we are collecting, as the persona and Kane are, in an attempt to make a coherent and meaningful whole out of our lives, and that we will fail as surely as they do. NOTES 1 T.S. Eliot, ââ¬Å"The Waste Land,â⬠in The Waste Land and Other Poems (New York: Harcourt Brace, 1962). 2 The original title of The Waste Land was a quote from Dickens's novel Our Mutual Friend, "He do the Police in different voices." 3 When I say that the poem lacks a coherent meaning, I mean that it has no more coherent meaning that life itself does. 4 "I am not Russian, I am out of Lithuania, a real German." 5 It is interesting to note the two meanings that this phrase can have. It could mean that the fragments are anchored in his literary tradition, or it could mean that it is set up as a bulwark to prevent his ruin.

Insulting language Essay
Great expectations might be read as a bildungsroman because it charts the progress of the main character, Pip, from childhood to adulthood. Traditionally, a bildungsroman contains a hero, who usually suffers early on in life, maturing and clashing with the social settings and eventually being accepted into it. The story focuses around this theme but doesnââ¬â¢t always play by its rules. In my essay I will be discussing to what point Great expectations can be read as a bildungsroman. ââ¬Å"Great expectationsâ⬠conforms to the genre of a bildungsroman right from the start of the book, in the opening scene we meet old pip talking about charting his life from when he was a little boy to a young gentleman. Like in most bildungsroman books Pip has suffered a loss at an early age, his parents, brothers and sisters. Pip has also had a harsh start to life because he lives with his sister who, even thought she is looking out for him, treats him quite badly. To even more extent the social hierarchy is established very early on as we find out that Mr. Joe is a blacksmith and this is important in order to judge Pipââ¬â¢s development, we can even tell from the language that he uses that he has a hard knock life and is not well off. The structure of the opening scene tells us a lot about how it conforms to the bildungsroman genre, the way Dickens immediately introduces us to both Pips. The old omnipotent storyteller Pip, who tells the story as he remembers it skipping out bits and stretching the truth a little. And the young ââ¬Å"actorâ⬠Pip who acts out what is happening while narrating it in 1st person which allows us to feel the harshness and changes that he is going through as he does which supports the bildungsroman framework. As I have mentioned before the language shows a lot about the type of life and the harshness of his life. E.g. Dark, flat, wilderness, low leaden line. Finally Dickens introduces the Convict who reinforces the social order and emphasises the harshness of Pips life, lastly he introduces the beginning of Pipââ¬â¢s great expectations. We first meet young pip in a cold and desolate church yard, looking at the graves of his parents and brothers this is important as it shows the harsh life he has had. In Chapter 1 we find out that Pip Has not had a childhood, he was bought up ââ¬Å"By handâ⬠suggesting that he has been disciplined harshly and ill Treated But with only the best in mind. We also found out that Pipââ¬â¢s Sister, Mrs. Joe, his only Relative in the world Who disciplines him so severely, Married the local town blacksmith which shows that Pipââ¬â¢s Family is poor and that pip is not so well educated As he calls himself Pip which is the only words he could pronounce. Even with the convict Pipââ¬â¢s Personality shines through, it shows that even though the Convict is threatening him severely But Pip still feels sympathy for him ââ¬Å"if he were eluding the hands of the dead peopleâ⬠, even when he is told that he must go and fetch him a file he still has the courtesy to say ââ¬Å"good night, sirâ⬠but Pip was also nervous ââ¬Å"he falteredâ⬠and scared ââ¬Å"I was dreadfully frightenedâ⬠. Old Pip is reporting what young Pip said and felt. As I have said in previous paragraphs Pip has had a hard life, Pipââ¬â¢s house is a small ââ¬Å"wooden houseâ⬠with a ââ¬Å"ditch clockâ⬠which is a cheap clock. Pip is also mistreated as he ââ¬Å"served as a connubial missileâ⬠and that he gets regular beatings from ââ¬Å"ticklerâ⬠. Pip is not the only one beaten ââ¬Å"Knowing her (Mrs. Joe) to have a hard and heavy hand, and to be much in the habit of laying it upon her husband as well as upon meâ⬠. Mrs. Joe is important because she represents the raising of the children in Victorian society, she helps us to lets us see how truly far Pips has come from being forced to intimidate higher class to actually being it. Joe is a ââ¬Å"fellow-suffererâ⬠of Mrs. Joe and he and Pip both treat each other like equals and share secrets more of having an older brother than him actually raising him as a father figure. It is important to see Pip at his home as we can feel sympathy for him and empathize what he ââ¬Å"isâ⬠going through. Dickens wants us to fell sympathy for him so we can realize what his life was like and how he has changed since his childhood. The robbery of the pie shows us how Pipââ¬â¢s fear for both Mrs. Joe and the convict and that his conscience about stealing from his sister, the one who brought him up ââ¬Å"by handâ⬠and fear from being caught or, if not doing it out of this fear, being killed by the convicts ââ¬Å"friendâ⬠. In chapter 7 we learn a lot about Pips education. Everything he has learnt was form Mr. Wopsles great auntââ¬â¢s school, but not from Mrs. Wopsle, from Biddy, her daughter. In Mrs. Wopsles School their only source of education was a single book that was passed around the class showing that Pip hasnââ¬â¢t had a very good education like many of the working class children in Victorian society. Pips education shows that he is slowly advancing in society and is trying to achieve his goals. However Pip thinks of himself as stupid when really he only thinks like this as he is not learning fast enough for him to like it and his surroundings make him believe it. Joe in comparison to Pip has had not much of an education, he cant even read where as Pip has become superior to him in his education and because of this we fell sorry for Joe because of the story of his childhood he tells us afterwards. Pip is invited to play at Miss Havershamââ¬â¢s house, this is important as it shows a crucial part of the bildungsroman genre, the ââ¬Å"shunning outâ⬠of the society that he wants to be accepted by, when Pip is playing at Satis house he is mixing with the higher class which represents a small leap to achieving his goals, while also giving him something else to aim at, Estella. Pip is treated badly by Estella because of his class making him feel poor and ââ¬Å"commonâ⬠, insulting the language he uses ââ¬Å"he calls the knaves, jacks!â⬠showing the difference in class which makes him upset and cry but the fact that she gets to him means that he likes her, urging him to change class ââ¬Å"the hands that have never bothered me before, look coarse and common nowâ⬠. Joe responds to Pip with helpful advice, saying that if he wants to be ââ¬Å"uncommonâ⬠he must do it the honest way because if he canââ¬â¢t heââ¬â¢ll never do it and we expect Pip to go and strike his goals.
